How to Go Bankrupt on the South Coast

How to go bankrupt is a question that we get asked quite a few times a week. It is quite easy to go bankrupt in England and Wales, and this is borne out by the facts that many hundreds of European citizens now turn up in the UK to live and work and end up going bankrupt and getting rid of their home country debt.

 

In the UK here the bankruptcy figures will rise from about 40,000 a year a few years ago to 120,000 a year probable this year.

 

If you want to start a bankruptcy process then you can log onto the Insolvency Service website and download the petition and the statement of affairs. Alternatively I have those forms available here.

 

The petition is quite straight forward to fill in but the statement of affairs is quite a different matter. It is 32 pages long and asks for quite detailed information. The more complex your affairs the more important it is to get right.

 

If you need help filling in any statement of affairs, then you may be able to book an appointment with your local CAB. Alternatively you can ask us to help you complete your papers.

 

When your paperwork has been completed it needs to be filed with your local court. You do need to call your call court and find out what process they have in place. It seems that different courts have their own processes. Some courts require that you book in for an appointment. This appointment can be many weeks ahead. Coventry is such an example of a court which operates this way.

 

Some courts, such as Leicester allow you to walk up on the day and present your petition. We can advise you what your court will do and book your appointment for you.

 

When your papers have been issued, you will need to have an appointment with a Judge. In some Courts this happens on the day, others pass the papers across the Judges desks after a few days, in others you need to come back the next morning.

The Order for your bankruptcy will be made once you have seen the Judge. You will then be contacted by the Official Receiver who will take control of your affairs. If you would like help with the Official Receiver for the next year, again we can provide that.
